Paul Balen and Andrew Hannam will explore mediation as a solution to resolve clinical negligence cases quickly, particularly in light of the log-jams in the courts, and describe how to take advantage of the judicial encouragement of mediation. They will outline their experience of the NHS Resolution Mediation Scheme and will include tips on how to prepare for, and conduct, mediations generally and in the current on-line world in particular. The presentation will compare and contrast mediation with joint settlement meetings and suggest how the lay client can participate fully, and, in the process, secure extra-judicial remedies as well as resolution of the civil claim.
